Powers of licensing authority to disqualify the Driving License of License Holder.-

For the purpose of clause (f) of sub-section (1) of section 19 of the MVAct,1988 & Rule 21 of CMV Rules 1989, the commission of the following acts by a holder of a driving license shall constitute nuisance or danger to the public, namely:

  • Theft of motor vehicle.
  • Assault on passengers.
  • Theft of personal effects of passengers
  • Theft of goods carried in goods carriages
  • Transport of goods prohibited under any law.
  •  Driver while driving a transport vehicle, engages him sole in activity which is likely to disturb his concentration.
  • Abduction of passengers
  • Carrying overload in goods carriages.
  • Driving at speed exceeding the specified limit
  • Carrying persons in goods carriage, either inside the Driver’s cabin in excess of its capacity or on the vehicle, whether for hire or not.
  • Failing to comply with the provisions of section 134 i.e. Duty of driver in case of Accident and injury to a person.
  • Failure to stop when signaled to do so by any person authorized to do so.
  • Misbehavior with and showing discourtesy to passengers, intending passengers or consignors and consignees of goods.
  • Smoking while driving public service vehicles.
  • Abandoning vehicle in a public place causing inconvenience to other road users or to passengers in the vehicle.
  • Driving vehicle while under the influence of drink or drugs.
  • Interfering with any person mounting or preparing to mount upon any other vehicle.
  • Allowing any person to sit or placing things in such a way as to impede the driver from having a clear vision of the road or proper control of the vehicle.
  • Not stopping a stage carriage at approved stopping places to a sufficient period of time in a safe and convenient position upon demand or signal of the conductor or any passenger desiring to alight from the vehicle and unless there is no room in the vehicle, upon demand or signal of any person desiring to becoming a passenger.
  • Loitering or unduly delaying any journey and not proceeding to the destination as near as may be in accordance with the time table pertaining to the vehicle, or, where there is no such time table, with all reasonable dispatch.
  • Not driving a contract carriage, in the absence of a cause, to the destination reasoned named by the hirer by the shortest route.
  • The driver of a motor cab not accepting the first offer of which may be made to him hire irrespective of the length of the journey such offer is made.
  • The driver of a motor cab demanding or extracting any  excess to that to which he is legally entitled or refusing to ply motor cab.
  • Abandoning a transport vehicle as a mark of protest or agitation of any kind of strike in a public place or in other place in a manner causing obstructions and inconvenience to the public or passengers or users of such places.

Instruction To Suspended DL Holders 

Suspended Driving License Holders are advised to follow below rules during DL Suspension Period.

  • Do not drive while DL is suspended.
  • Surrender DL to registering Authority.
  • After the Suspension Period over, the suspended DL will be automatically restored.
  • If the driver is involved in any accident during the DL suspension period, the driver will be penalized under Section 182.
